I. Definitions

The terms used in these Terms and Conditions mean:

  1. Client – a natural person, legal person, or an organizational unit without legal personality, which the law grants legal capacity, making an Order within the Store;
  2. Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);
  3. Regulations – these Regulations for the provision of electronic services within the online store www.rukemirrors.co.uk;
  4. Online Store (Store) – the online service available at www.rukemirrors.co.uk, through which the Client can, in particular, place Orders;
  5. Goods – products presented in the Online Store;
  6. Sales Agreement – a sales contract for Goods within the meaning of the Civil Code, concluded between RUKE Zbigniew Rus (registered at ul. Słowackiego 11, 24-100 Puławy, NIP: 716-164-40-60, REGON: 430764316) and the Client, using the Store’s website;
  7. Act on the provision of electronic services – the Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);
  8. Consumer Rights Act – the Act of May 30, 2014, on consumer rights (i.e., Journal of Laws No. 2017, item 683, as amended);
  9. Order – the Client’s declaration of will directly aiming at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.

II. General Provisions

2.1. These Regulations define the rules for using the online store available at www.rukemirrors.co.uk.

2.2. These Regulations are the regulations referred to in Art. 8 of the Act on the provision of electronic services.

2.3. The online store operating at www.rukemirrors.co.uk is run by RUKE Zbigniew Rus (registered at ul. Słowackiego 11, 24-100 Puławy, NIP: 716-164-40-60).

2.4. These Regulations specify in particular:

a.) the rules for registration and use of an account within the online store; b.) the terms and conditions for making electronic reservations of products available within the online store; c.) the terms and conditions for placing Orders electronically within the online store; d.) the rules for concluding Sales Agreements using the services provided within the Online Store.

2.5. Using the online store is possible provided that the Client’s ICT system meets the following minimum technical requirements:

a.) Internet Explorer version 4.0 or newer with cookies enabled, or b.) Mozilla Firefox version 4.0 or newer with cookies enabled, or c.) Google Chrome version 1.0 or newer with cookies enabled.

2.6. To use the online store, the Client should independently gain access to a computer or terminal device with Internet access.

2.7. In accordance with applicable law, RUKE Zbigniew Rus reserves the right to limit the provision of services through the Online Store to persons who are at least 18 years old. In such cases, potential Clients will be notified.

2.8. Clients can access these Regulations at any time via a link found on the homepage of the www.rukemirrors.co.uk website and download and print them.

2.9. Information about Goods provided on the Store’s websites, in particular their descriptions, technical and functional parameters, and prices, constitutes an invitation to conclude an agreement, within the meaning of Art. 71 of the Civil Code.

III. Terms of Use of the Online Store

3.1. The condition to start using the Online Store is registration within its framework.

3.2. Registration is done by completing and accepting the registration form provided on one of the Store’s pages.

3.3. The condition for registration is to agree to the content of the Regulations and to provide personal data marked as mandatory.

3.4. RUKE Zbigniew Rus may deprive the Client of the right to use the Online Store and may limit their access to part or all of the Online Store’s resources with immediate effect in the event of the Client’s violation of the Regulations, and in particular when the Client:

a.) provided false, inaccurate, or outdated data during registration in the online store, misleading or violating the rights of third parties, b.) committed an infringement of personal rights of third parties via the online store, in particular the personal rights of other clients of the online store, c.) engages in other behaviors that will be recognized by RUKE Zbigniew Rus as behaviors inconsistent with applicable law or general rules of using the Internet or detrimental to the good name of RUKE Zbigniew Rus.

3.5. A person who has been deprived of the right to use the online store may not re-register without the prior consent of RUKE Zbigniew Rus.

3.6. To ensure the security of message transmission and data related to the services provided within the Website, the Online Store undertakes technical and organizational measures appropriate to the degree of security risk of the services provided, in particular measures to prevent the acquisition and modification of personal data transmitted on the Internet by unauthorized persons.

3.7. The Client is particularly obliged to:

a.) not provide or transmit content prohibited by law, e.g., content promoting violence, defamatory, or violating personal rights and other rights of third parties, b.) use the online store in a way that does not disrupt its functioning, in particular through the use of specific software or devices, c.) not take actions such as: sending or placing unsolicited commercial information (spam) within the online store, d.) use the online store in a way that is not burdensome for other clients and for RUKE Zbigniew Rus, e.) use any content posted within the online store only for personal use, f.) use the online store in a manner consistent with the provisions of applicable law in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general rules of using the Internet.

IV. Procedure for Concluding a Sales Agreement

4.1. To conclude a Sales Agreement via the Online Store, you must visit the website www.rukemirrors.co.uk, select the products and their quantity (expressed in units, depending on the type of product), and follow the technical steps based on the instructions and information displayed to the Customer on the website. The product images shown on the website are for illustrative purposes only and may not accurately reflect the exact appearance or proportions of the products.

4.2. The selection of ordered Goods by the Client is made by adding them to the cart.

4.3. When placing an Order – until the button “Order” is pressed – the Client has the option to modify the entered data and in the selection of Goods. For this purpose, follow the displayed messages and information available on the website.

4.4. After the Client using the Online Store has provided all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will include information on:

a.) the subject of the order, b.) the unit and total price of the ordered products or services, including delivery costs and additional costs (if any), c.) the chosen payment method, d.) the chosen delivery method.

4.5. To send the Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory, and press the “Place Order” button.

4.6. Sending the Order by the Client constitutes a declaration of will to conclude a Sales Agreement with RUKE Zbigniew Rus, in accordance with the content of the Regulations.

4.7. After placing the Order, the Client receives an email titled “Order Confirmation,” containing the final confirmation of all essential elements of the Order.

4.8. The agreement is considered concluded upon the Client’s receipt of the email referred to above.

4.9. The Sales Agreement is concluded in the Polish language, with the content in accordance with the Regulations.

V. Procedure for Concluding a Sales Agreement by Phone

5.1. To place an Order via phone, the Customer contacts the Seller’s employee at the number available on the website www.rukemirrors.co.uk during the specified hours and days. The cost of the call to the Seller is borne by the Customer according to the operator’s rates.

5.2. A prerequisite for connecting with the Seller’s employee is familiarity with the contents of these Terms and Conditions as well as the online store’s terms and conditions, available on the website sklep.ruke.eu.

5.3. During the phone conversation, the Seller’s employee provides the Customer with information about the prices of the Products the Customer is interested in, verifies their availability, and may suggest ordering an additional service. The Seller’s employee presents basic information about the legal consequences of concluding the agreement and answers any questions, providing clear, understandable, and non-misleading information.

5.4. When placing an Order by phone, the Customer provides the Seller’s employee with the name of the Product and the quantity of Products they wish to order. The Customer also has the option to order additional attributes. Then, after compiling the entire Order, the Customer specifies the delivery method and address, the payment method, and provides their email address for Order confirmation. Each time an Order is placed by phone, the Customer is informed about the Seller with whom the sales agreement will be concluded, the total price of the selected Product or Product and additional service (along with the method of execution), the total cost of the chosen delivery method, and all additional costs that the Customer is obliged to bear in connection with the sales agreement. The Customer confirms the Order, makes any reservations, requests to supplement the order, or cancels its execution.

5.5. The Customer is obliged to provide a full and correct shipping address and phone number, which should not change until delivery. Changing the delivery address is only possible in exceptional circumstances upon agreement with the Seller and before the Products are handed over to the carrier for delivery.

5.6. Placing an order in accordance with Article 5.4 of the Terms and Conditions occurs during the phone call. At that moment, a sales agreement is concluded between the Seller and the Customer.

5.7. After the phone call, the Customer receives an Order confirmation from the Seller at the email address provided during the phone conversation.

VI. Delivery

6.1. The delivery of ordered Goods is carried out via courier shipment. Delivery costs are available on the Delivery and Payments page. Additionally, delivery costs will be indicated during the Order placement process.

6.2. The delivery time is from 9 to 45 business days from the day of sending the Order by the Client in the case of cash on delivery payment or from the date of payment receipt in advance.

6.3. Clients can access these Regulations at any time via a link found on the homepage of the www.rukemirrors.co.uk website and download and print them.

Recording, securing, providing access, and confirming the Client’s essential provisions of the Sales Agreement for Goods is done by sending the Client an email to the provided email address and attaching a printout of the confirmation, Order specification, and VAT invoice to the shipment containing the Goods.

VII. Prices and Payment Methods

7.1. The prices of Goods are given in Polish zlotys and include all components, including VAT, customs duties, and other fees.

7.2. The Client can pay the price:

a.) by bank transfer to the account number

7.3. Transactions with credit cards and e-transfers are processed via PayPal.

VIII. Right to Withdraw from the Agreement

8.1. The Client, being a consumer within the meaning of Art. 221 of the Civil Code, has the right – based on legal provisions – to withdraw from a distance agreement without giving any reason, by submitting an appropriate statement in writing within 14 days and sending it to the address of RUKE Zbigniew Rus provided in these Regulations. The template withdrawal statement is Annex No. 1 to the regulations.

8.1.a Only the Client being a Consumer and the Client conducting a sole proprietorship, registered in CEIDG*, has a 14-day period to withdraw from the agreement. According to Art. 22(1) of the Civil Code, a Consumer is considered a natural person entering into a legal transaction with an entrepreneur not directly related to their business or professional activity.

*Art. 38a, “Provisions concerning the consumer contained in this chapter apply to a natural person entering into an agreement directly related to their business activity, when it results from the content of this agreement that it does not have a professional nature for that person, resulting in particular from the subject of their business activity made available based on the provisions on the Central Registration and Information on Business.”

8.2. The 14-day period is counted from the day the Goods were delivered, and in the case of delivery of multiple Goods that are delivered separately – from the delivery of the last batch of Goods.

8.3. The right to withdraw from the agreement by the consumer is excluded in the case of goods (services) exceeding the standard offer of the store, prepared on a special order of the client, and tailored to their individual needs. In the case of the store: www.rukemirrors.co.uk, these will be mirrors made to individual dimensions, entered manually during the order placement (outside the catalog of standard dimensions), mirrors for which glass cuts were made (models: Milly, Luna, Nelly, etc.), and goods for which the Client selected additional attributes exceeding the standard, i.e., – Light color, Manufacturing technology, Switch;

8.4. In the event of withdrawal from a distance agreement, the agreement is considered not concluded. What the parties have provided shall be returned unchanged unless the change was necessary within the ordinary management. The return should occur immediately, no later than within 14 days. The purchased goods should be returned to the following address:

RUKE Zbigniew Rus, ul. Słowackiego 11, 24-100 Puławy.

8.5. The Goods returned by the Client should be packed appropriately in the original box, ensuring no damage to the shipment during transport.

8.6. The cost of transport of the goods in case of return is borne by the Seller.

IX. Complaints about Goods

9.1. The ordered item is subject to complaints.

9.2. RUKE Zbigniew Rus, as a seller, is responsible to the Client who is a consumer within the meaning of Art. 221 of the Civil Code, for non-compliance with the Sales Agreement of Goods purchased by this consumer, to the extent specified by the Consumer Rights Act.

9.3. Complaints resulting from the violation of the Client’s rights guaranteed by law, or based on these Regulations, should be directed to info@rukemirrors.co.uk. RUKE Zbigniew Rus undertakes to consider each complaint within 14 days.

9.4. The Goods complained about by the Client should be packed in the original box, ensuring no damage to the shipment during transport.

9.5. Complaints resulting from damage to the goods during transport should be reported immediately on the day of receipt of the shipment. The report should include a damage protocol written in the presence of the courier and photographic documentation. Reporting damage after 24 hours will be considered as having occurred at the client’s location.

X. Complaints regarding the provision of electronic services

10.1. RUKE Zbigniew Rus undertakes actions to ensure fully correct operation of the Store, to the extent resulting from the current technical knowledge and undertakes to remove any irregularities reported by Clients within a reasonable time.

10.2. The Client is obliged to immediately notify RUKE Zbigniew Rus of any irregularities or interruptions in the functioning of the Online Store’s website.

10.3. Irregularities related to the functioning of the Store can be reported by the Client in writing to the address: RUKE Zbigniew Rus, ul. Słowackiego 11, 24-100 Puławy, by email to info@rukemirrors.co.uk or using the contact form.

10.4. In the complaint, the Client should provide their name, mailing address, type, and date of occurrence of irregularities related to the functioning of the Store.

10.5. RUKE Zbigniew Rus undertakes to consider each complaint within 14 days.

XI. Privacy Policy

I. Who processes personal data and for what purpose

Personal data provided to us by you in connection with registration and use of the Online Store rukemirrors.co.uk are processed by RUKE Zbigniew Rus based in Puławy at ul. Słowackiego 11, NIP: 716-164-40-60, which is the data controller in accordance with applicable regulations, in particular Polish law and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR).

  1. to the extent necessary to establish, shape the content, change, terminate, and correctly perform services provided electronically and fulfill your orders;
  2. to fulfill your orders for products in the assortment of the Online Store rukemirrors.co.uk;
  3. to consider your complaints and return benefits in the case of withdrawal from the agreement (return of goods);
  4. if you agree to receive marketing information from us, including sending you commercial information by electronic means, your personal data will also be processed by us to provide you with information about our store, offers, and promotions, as well as information about products and services of entities cooperating with us (with our knowledge and explicit consent).

To perform the agreement, the online store may provide collected data to partners such as courier companies, payment system operators, complaint handling companies, etc. In such cases, the amount of data provided is limited to the necessary minimum. Additionally, the information provided by you may be made available to competent public authorities if required by applicable law.

Providing personal data is voluntary, but the lack of consent to their processing may prevent us from providing you with services electronically and making purchases in the Online Store rukemirrors.co.uk.

By entrusting us with your personal data, you have the right to access them, request their update, and request their deletion. You can edit and delete personal data provided in the Client’s account yourself (the “Your Account” tab). You can also ask us to delete the entire Client’s account by sending an appropriate request to info@rukemirrors.co.uk from the email address currently registered in the Online Store rukemirrors.co.uk. If you wish to unsubscribe from the newsletter, you can do it yourself or by contacting us from the email address currently registered in the Online Store rukemirrors.co.uk. Information on how to unsubscribe from the newsletter is also indicated in the footer of each newsletter.

II. Security Rules

RUKE Zbigniew Rus ensures the security of personal data through appropriate technical and organizational measures to prevent unlawful data processing and accidental loss, destruction, or damage. We also take special care to ensure that personal information is:

accurate and processed lawfully, obtained only for specified purposes and not further processed in a way incompatible with those purposes, adequate, relevant, and not excessive, accurate and up to date, not kept longer than necessary, processed in accordance with the rights of the individuals (whom they concern), including the right to reserve access, securely stored, not transferred without adequate protection.

Remember that your nickname and email address provided as public will be visible to all users of the Online Store rukemirrors.co.uk. If you do not want to share personal data with an unlimited circle of people, do not provide them as public.

For your safety, remember to:

  1. set up a login and password for your Client’s account that cannot be easily guessed by third parties. In particular, we recommend using a combination of characters and numbers as well as uppercase and lowercase letters;
  2. log out of the rukemirrors.co.uk site after each session (completed shopping, adding messages on the forum, etc.). Simply closing the browser window does not equal logging out from the rukemirrors.co.uk site. Logging out from the rukemirrors.co.uk site will occur after clicking the “Logout” button;
  3. keep the login and password to the Client’s account secret, especially do not disclose the data (login, password) to any third parties;
  4. use antivirus programs, including regularly scanning disks for viruses;
  5. use the rukemirrors.co.uk website and Online Store only through trusted computers with only verified software installed. Using others’ computers carries the risk of intercepting your login, password, or other data you provide;
  6. however, if you use the rukemirrors.co.uk site and Online Store via a public computer, such as in an internet cafe, remember not to save the data on the computer and to delete the browsing history. The saved data may be used by the person who will use the computer after you.

III. Technical Information

Technical information – cookie files

When you use the Online Store rukemirrors.co.uk, small files (especially text files) containing information necessary for the proper use of the Online Store rukemirrors.co.uk, so-called cookie files, are saved on your end device (computer, smartphone, tablet, etc.). By saving these files on your device, it is possible, among other things, to remember your login data, so you will not need to enter your login and password each time, remember the goods added to your cart, or customize the page content to your interests. Thanks to cookie files, it is possible to collect statistical data of the Online Store rukemirrors.co.uk, which allows us to develop the Store according to our Clients’ preferences.

Cookies do not contain identifying data, and they cannot be used to establish anyone’s identity. These files are not harmful to your device and do not change its settings or the software installed on it. The content of these files can only be read by the server that created them.

f) Social files – allow the integration of social media services (including Facebook, Google+, Pinterest), which you use, with the Store.

What to do if you do not agree to save cookies on your device?

Most browser settings allow the storage of cookies by default. If you do not agree to the storage of these files on your device, you must change the settings of your web browser accordingly. The change can involve not saving cookies on your device or informing you each time a file is saved on your device. You can also delete files from your device each time you visit the Store. Detailed information about the possibilities and ways to handle cookies are available in the settings and the “Help” section of your web browser. However, please note that restrictions on the use of cookies may hinder or make it impossible to use the Store.

The settings of your device’s browser allowing cookies to be saved mean that you consent to these files being saved on your device.

Other technical information

Your personal data is stored in a database that employs technical and organizational measures ensuring data processing protection in compliance with the requirements specified by generally applicable data protection regulations, including the Regulation of the Minister of Internal Affairs and Administration of April 29, 2004, on personal data processing documentation and technical and organizational conditions to be met by devices and IT systems used for personal data processing (Journal of Laws No. 100, item 1024). Only persons authorized by the data administrator have access to the database.

XII. Final Provisions

12.1. Any disputes arising between RUKE Zbigniew Rus and a Client who is a consumer within the meaning of Art. 221 of the Civil Code will be submitted to competent courts in accordance with the provisions of the relevant Civil Procedure Code.

12.2. Any disputes arising between RUKE Zbigniew Rus and a Client who is not a consumer within the meaning of Art. 221 of the Civil Code will be submitted to the court having jurisdiction over the seat of RUKE Zbigniew Rus.

12.3. Matters not regulated in these Regulations are subject to the provisions of the Civil Code, the provisions of the Act on the provision of electronic services, and other applicable Polish legal regulations.
